By accessing VoxNote, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this application or using any other services provided by VoxNote Softwares inc..
We, VoxNote Softwares inc., reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

The Acceptable Use Policy is an integral part of these Terms of Service. By using VoxNote, you agree to comply with the Acceptable Use Policy, which outlines the rules for using our platform responsibly and legally.
Registration Obligations. You must register for our App using accurate information and provide your current mobile phone number. You agree to receive text messages and phone calls (from us or our third-party providers) with codes to register for Our App. Please note that continued access to the mobile phone number used to create your account is required for the continuous use of the Services. You hereby acknowledge and agree that you might lose access to your account in the event you lose control of such mobile phone number.
By registering, Users agree to be fully responsible for all activities that occur under the account associated with their mobile phone number used at the time of signing up. Users are required to immediately and unambiguously inform us if they think their personal information, including but not limited to their account, access credentials or personal data, have been violated, unduly disclosed or stolen. Registration to our Services is subject to the following conditions:
Users can terminate their account and stop using the Services at any time.
We reserve the right to suspend or terminate your account at any time and without notice, at our sole discretion, in the following cases:
The suspension or deletion of your account shall not entitle Users to any claims for compensation, damages or reimbursement and does not exempt the User from paying any applicable fees.
Storage: Except where required by law, VoxNote Softwares is not obligated to store your voicemails, sent/received calls, text messages, pictures, and/or other information maintained or transmitted by the Services. You agree that Interface has no responsibility or liability whatsoever for the deletion or failure to store any voicemail and/or other information maintained or transmitted by the Service.
By using this application, you warrant on behalf of yourself, your users, and other parties you represent that you will not:
modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this application;
remove any copyright or other proprietary notations from any materials and software on this application;
transfer the materials to another person or "mirror" the materials on any other server;
knowingly or negligently use this application or any of its associated services in a way that abuses or disrupts our networks or any other service VoxNote Softwares inc. provides;
use this application or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
use this application or its associated services in violation of any applicable laws or regulations;
use this application in conjunction with sending unauthorized advertising or spam;
harvest, collect, or gather user data without the user's consent; or
use this application or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties;
rely on transcriptions or summaries as legal, medical, financial, or other professional advice, or as certified documents or evidence in judicial, administrative, or regulatory proceedings;
use VoxNote to spy on, monitor, or covertly collect information about individuals without their explicit knowledge and consent, in violation of applicable privacy laws;
use transcriptions, summaries, or any content generated by VoxNote as a legal source, evidence, or representation in legal proceedings or disputes.
VoxNote Softwares inc.'s Products allow customers to record, transcribe, and summarize phone calls. Because recording obligations vary by jurisdiction and context, customers are responsible for understanding and complying with all applicable laws when using our Products.
Before using VoxNote to record a call, the customer is responsible for informing all participants and obtaining any legally required consent. Requirements vary based on each participant's jurisdiction and the context of the call.
These technical protections limit data-related risks, but they do not replace the customer's obligation to notify the other party when the law requires it.
The answer depends on the context in which the customer uses VoxNote and the country
Individual to Individual (personal conversation) — Generally, no.Recording a conversation without the other party's knowledge is not in itself considered harmful. It is the misuse of the recording (disclosure, sharing, malicious use) that may lead to consequences. No rule prevents an individual from recording their own private conversations without notifying the other party.
Business to Individual (business context with a client) — Generally, yes.The customer must have serious and legitimate reasons to record a conversation with an individual who is not operating a business, and must make a reasonable effort to inform them of the purpose of the recording.
Business to Business — Generally, no.When the conversation takes place between two individuals acting in the course of their work, the parties theoretically have only a minimal expectation of privacy. Unless there are special circumstances (for example, a discussion involving privileged financial information), notifying the other party of the recording is generally not required.
The answer depends on the state where you and the other party are located.
One-party consent states: Generally, no.In 38 states and Washington D.C., only one party needs to consent to the recording, and that party can be you. You are therefore not legally required to notify the other party, unless a specific state law imposes a stricter rule in certain contexts (for example, certain business communications or the collection of sensitive personal information).
All-party consent states: Generally, yes.In 12 states (California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Washington), all parties to the conversation must be informed that the call is being recorded before the discussion begins. A verbal statement at the start of the call is typically sufficient. If the other party continues the conversation after being notified, their consent may be considered implied.
When parties are in different states: apply the strictest applicable law.If you are in a one-party state and the other party is in an all-party state (or vice versa), the stricter law generally applies. When in doubt about your contact's exact location, notifying at the start of every call is compliant across all 50 states.
VoxNote starts recording automatically at the beginning of each call. If the customer is in a context that requires notification, they must notify the other party ideally within the first few seconds of the call and before any personal information is exchanged.
Recommended method: verbal disclosure.As soon as the call begins, the customer should clearly tell the other party:
Tip for recurring clients.When speaking with a client in a business context, the customer can use this disclosure to obtain consent not only for the current call but also for all future calls. This avoids repeating the process every time and provides durable proof of consent in the client file.

The intellectual property in the materials contained in this application are owned by or licensed to VoxNote Softwares inc. and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.
This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by VoxNote Softwares inc. at any time.
Our application and the materials on our application are provided on an 'as is' basis. To the extent permitted by law, VoxNote Softwares inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall VoxNote Softwares inc. or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this application or the materials on this application, even if VoxNote Softwares inc. or an authorized representative has been notified, orally or in writing, of the possibility of such damage.
In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
We may suspend or terminate your right to use our application and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
These Terms of Service are governed by and construed in accordance with the laws of Canada. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
VoxNote Softwares inc. may send SMS and/or MMS communications for promotional, conversational, and informational purposes, but only with the prior express consent of the recipient.
When you opt-in to receive SMS/MMS communications from VoxNote Softwares inc., you expressly consent to VoxNote Softwares inc. sending you SMS and/or MMS messages for the purposes described in "SMS/MMS Communications". VoxNote Softwares inc. does not charge any fees for these messages; however, message and data rates may apply, as determined by your mobile carrier.
VoxNote Softwares inc. may use an automatic telephone dialing system (“ATDS”) or other automated technologies to send you SMS and/or MMS messages for the purposes described in "SMS/MMS Communications". By providing your consent, you acknowledge and agree to receive such communications delivered through automated technologies.
To opt out of SMS communications at any time, reply with “STOP” or “UNSUBSCRIBE” to any SMS/MMS message we send you.
If you unsubscribe from receiving text messages, there may be a short delay while VoxNote Softwares inc. processes your request(s). During this time, you may continue to receive SMS communications from us.

Please note that prior to engaging with a person who is not a user of the App you must obtain consent to communicate with them. You must make clear to the recipient that they agree to discuss and have the conversation recorded and processed by the App and/or any third parties engaged by VoxNote Softwares for the provision of the Services.
You agree that you are responsible for informing the recipient that the call is being made using the App and that it might be recorded and or stored by VoxNote Softwares for the provision of the Services. The phone call recordings are securely stored and then completely deleted and destroyed after 30 days, as per our Privacy Policy.
VoxNote Softwares shall not be responsible for any damage arising from the communications with a non-user of the App. All information collected will be treated as per the Privacy Notice.
When you sign up for our App and subscribe to Paid Subscription, we allocate a unique phone number to you (“Unique Number”), allowing you to send text messages and make calls to people in your address book with a Canadian or American phone number (country code: +1) who do not use Our App. This functionality is designed to integrate seamlessly with your existing contact list, allowing for a user-friendly communication experience.
The Unique Number is owned by VoxNote Softwares and is provided to you for use exclusively within the context of Our App's services. We retain the right to reallocate your Unique Number to another user within a month after you cancel your subscription, or in the event of any failure to comply with the laws applicable to the usage of a phone number or these Terms.
Reallocation of your Unique Number means that any previous communications or identity associated with the old number will no longer be linked to you in the App.
If your Unique Number is reallocated, you will be provided a new Unique Number upon your next subscription to Paid Subscription.
VoxNote Softwares cannot guarantee that any specifically requested telephone numbers or area codes will be available or remain available. VoxNote Softwares will not be liable for reimbursement for any expenses or any other damages you incur related to the assignment of a specific telephone number, including but not limited to business cards, stationery, event bookings, press releases or any other post or advertisement under any conditions, or for any other alleged damages, including without limitation consequential or special damages arising from any alleged failure to provide you with a specific telephone number or if your assigned number becomes unavailable or must be reassigned for any reason at any time.
